Buying Commercial Property Through Your SMSF: A 2026 Guide for First-Time Buyers

Oct 27, 2026 · Dave Kertesz

Why buying commercial property through your SMSF makes sense in 2026

If you are thinking about buying commercial property through your SMSF, 2026 has changed the conversation. Commercial property is now the only real estate an SMSF can buy with borrowed money, and super funds were left out of the budget's tax crackdown on property investors.

At Crew Commercial we are fielding more calls than ever from first-time SMSF buyers across the Gold Coast, Brisbane and South East Queensland. This guide walks you through how it works, the steps from setup to settlement, and why commercial now stacks up so well against residential.

SMSF property basics: how buying through super works

You cannot buy property with a regular industry or retail super account. To hold property directly, you need a self-managed super fund (SMSF), where you and up to five other members act as the trustees and make the investment decisions.

The property belongs to the fund, not to you personally. That brings a few ground rules:

  • Sole purpose test. The property must be held purely to provide retirement benefits. You, your family and related parties cannot live in it or use it personally.
  • Arm's length dealings. Everything, from the purchase price to the rent, must be on commercial terms.
  • Business real property is the exception that matters. Land and buildings used wholly and exclusively in a business can be bought from, and leased to, a related party such as your own business, provided rent is at market rates. Residential property cannot.
  • Borrowing is limited. An SMSF can only borrow through a limited recourse borrowing arrangement (LRBA), where the lender's claim is restricted to that one property and it is held in a separate bare (custodian) trust until the loan is repaid.

That last point is where 2026 has made the biggest difference, which we cover below.

How to buy commercial property through your SMSF in 7 steps

Getting the order right is what keeps a deal from falling over, especially if you are borrowing.

  1. Get advice before anything else. Speak with an SMSF accountant and a licensed financial adviser about whether an SMSF suits your balance, age and goals. Setup and running costs are fixed, so the fund needs enough in it to make those costs worthwhile and still buy a property.
  2. Establish the SMSF. Your adviser will prepare the trust deed, appoint trustees (a corporate trustee is usually recommended), register the fund with the ATO, open a bank account and roll your super across. Your written investment strategy must allow for direct property and address liquidity and diversification.
  3. Line up finance and the borrowing structure. If you plan to borrow, talk to a lender with an SMSF product early. Set up the bare trust and its custodian company before you sign anything, because the contract has to be in the right name from day one.
  4. Find the right property. Work out your brief: owner-occupied premises for your own business, or an investment with an existing tenant. Look at zoning, lease terms, tenant strength, outgoings recovery and yield. On the Gold Coast, strata industrial and warehouse units in the Northern Gold Coast corridor, from Coomera to Yatala, are a common starting point for SMSF buyers. This is where an experienced local commercial agent earns their keep.
  5. Confirm it qualifies. If you are borrowing, or leasing to your own business, the property must be business real property, meaning it is used wholly and exclusively in a business. Zoning alone does not decide this, so have your adviser confirm it for the specific property.
  6. Do your due diligence. Review the lease, building condition, compliance and environmental reports. Ask your accountant about GST (many tenanted sales are a going concern) and budget for Queensland transfer duty, which an SMSF pays at the general rates.
  7. Settle and manage it properly. Rent must be paid into the SMSF bank account, and every cost, from rates to repairs, must be paid by the fund. Keep the lease at market rent, get regular valuations and expect an annual independent audit.

SMSF commercial vs residential property after the 2026 budget

The 2026-27 Federal Budget, handed down on 12 May 2026, and the tax package that passed in June have tilted the field firmly towards commercial property inside super. Three changes matter most.

  1. SMSFs can no longer borrow to buy residential property. The Treasury Laws Amendment (Tax Reform No. 1) Act 2026 received Royal Assent on 26 June 2026. Since 10 August 2026, any new SMSF borrowing to buy real property must be for business real property. Houses, units and vacant land no longer qualify. Existing loans are grandfathered, but for new buyers, commercial premises are now the only property you can gear inside super.
  2. Residential investors outside super lose negative gearing. For established homes bought in your own name after 7:30pm AEST on 12 May 2026, rental losses from 1 July 2027 can only be offset against other residential property income, not your salary. Complying super funds, including SMSFs, are excluded, and commercial property was never in scope.
  3. The CGT discount is gone for individuals, but not for super. From 1 July 2027, the 50% capital gains tax discount for individuals, trusts and partnerships is replaced by cost base indexation and a 30% minimum tax rate on gains. SMSFs keep their one-third discount, so a long-held gain is taxed at an effective 10% in accumulation phase and nothing in pension phase.
Commercial property in an SMSF Residential property in an SMSF Established residential in your own name (bought after 12 May 2026)
Borrow to buy Yes, if it is business real property No new loans since 10 Aug 2026 Yes
Lease to your own business Yes, at market rent No Not applicable
Tax on net rent 15%, or 0% in pension phase 15%, or 0% in pension phase Your marginal rate
Rental losses Offset within the fund as usual Offset within the fund as usual Quarantined to residential income from 1 Jul 2027
Capital gains One-third discount retained One-third discount retained Indexation plus 30% minimum rate from 1 Jul 2027

On top of the tax settings, commercial property has always suited super well. Leases tend to run longer, tenants commonly cover outgoings, and yields have typically sat above residential. For business owners, buying your own premises through your SMSF means your rent builds your retirement savings instead of a landlord's.

One caveat for larger balances: Division 296 started on 1 July 2026 and adds extra tax on earnings attributable to balances above $3 million. Most first-time buyers will sit well below that, but it is worth raising with your adviser.

Common SMSF property mistakes first-timers make

  • Signing the contract in the wrong name. If you are borrowing, the property must be bought by the custodian trustee of the bare trust. Fixing the wrong name after signing can mean extra stamp duty or a non-compliant loan.
  • Assuming "commercial" means "business real property". The test is how the property is used, and for any new loan it must keep qualifying for the life of the loan. Check before you buy.
  • Leaving the fund with no cash. The SMSF has to cover loan repayments, rates, insurance and repairs, including during a vacancy. Keep a buffer.
  • Paying costs personally. Topping up the fund by paying a bill from your own account can breach the rules. All money in and out should run through the SMSF.
  • Mates' rates. Leasing to your own business below market rent, or letting rent go unpaid, can trigger serious tax penalties. Get a market rent appraisal and stick to the lease.

SMSF commercial property FAQs

Can my SMSF still borrow to buy property in 2026?

Yes, but only for business real property. Since 10 August 2026, any new SMSF loan to buy real estate must be for property used wholly and exclusively in a business. New loans for houses, units and vacant land are no longer allowed, although loans taken out before that date can continue and be refinanced.

Can my SMSF buy my business premises and lease them back to me?

Yes, if the property is business real property. Your SMSF can buy it from you or a related party at market value and lease it to your business, as long as the rent and lease terms are at market rates and the rent is actually paid.

How much super do I need to buy commercial property through an SMSF?

There is no legal minimum. In practice, the fund needs enough for the deposit, transfer duty, legal and setup costs, plus a cash buffer, and lenders set their own deposit requirements for SMSF loans. Your accountant or adviser can tell you whether your balance makes it worthwhile.

Does negative gearing still work for property in an SMSF?

Yes. Complying super funds, including SMSFs, are excluded from the 2026 negative gearing changes. A property loss can still be offset against the fund's other taxable income, and commercial property was never part of those changes.

What tax does an SMSF pay on commercial property?

In accumulation phase, net rental income is taxed at 15%. Capital gains on property held for more than 12 months get a one-third discount, giving an effective rate of 10%. Once the fund moves into pension phase, both can fall to 0%.

Can I use a commercial property owned by my SMSF?

Only through a proper lease. Your own business can occupy business real property owned by your SMSF if it pays market rent under a formal lease. You cannot use it rent free or for personal purposes.
